Use and Service Agreements at Munco Arquitectura

We’re deeply grateful that you’ve chosen to be part of our collective project — a network of Mexican professionals united by solidarity, equity, collaboration, and mutual care. We create high-quality services through a shared vision of dignity, justice, and sustainable work.

Our goal is for your experience to be clear, transparent, and meaningful from the very first moment — whether you're exploring our digital platform (munco.mx/arquitectura), reaching out via WhatsApp, or calling us directly. From now on, we’ll refer to all these channels collectively as "Munco."

As with any service, there are clear guidelines that help us ensure a fair and respectful relationship between those who offer services and those who receive them. By browsing our platforms, requesting a quote, or contracting any of our services, you accept these Terms and Conditions, as well as our Privacy Notice.

Accessing the Munco Arquitectura website (munco.mx/arquitectura) or using any of its services means you agree to these Terms and Conditions and our Privacy Notice. These documents define our relationship and ensure everyone knows what to expect.

Munco is not a company. It’s a community of professionals exercising our fundamental right to organize, associate, and unite around common goals. Together, we’re building fairer, more sustainable alternatives to traditional labor and economic models.

We are currently in the process of fulfilling the legal requirements to formally establish ourselves as a cooperative.

Until then, each service offered and available for hire is provided by an independent professional member of our community. In every quote or financial proposal, you will see the name of the person responsible for the service. All members commit to upholding the same collective standards of quality, privacy, and responsibility.

For any legal matters, the individual professionals listed in official quotes and invoices issued by Munco are the responsible parties.

  • These “Terms of Use” apply to the Munco website located at www.munco.mx/arquitectura, as well as to all associated sites linked from it, including those we operate in different parts of the world (all of which we refer to as the “Site”). The Site is collectively owned by the individuals who form part of Munco.

    We at Munco reserve the right to update, modify, add, or remove any of these terms as necessary. It is your responsibility to periodically review these Terms of Use to stay informed about any changes. If you continue using the Site after modifications are published, we will understand that you accept the new conditions.

    As long as you comply with these Terms of Use, we grant you limited, non-exclusive, and non-transferable access to explore and use our Site.

  • All text, graphics, visual or interactive interfaces, photographs, trademarks, logos, sounds, music, images, source code, and other elements appearing on the Site (collectively, the “Content”) — including its design, structure, selection, coordination, style, and arrangement — are owned by the individuals who make up Munco, or by third parties who have granted authorized licenses. The Content is protected by copyright, trademark, and intellectual property laws, but it is shared under a specific Creative Commons license to promote ethical knowledge sharing.

    Unless otherwise explicitly stated in these Terms of Use, you may not copy, reproduce, republish, download, post, publicly display, translate, transmit, distribute, or modify the Site in any way, whether for personal or commercial use, without prior written consent from the members of Munco.

    However, you are permitted to use, copy, and redistribute the material from the Site under the terms of the Creative Commons Attribution 4.0 International License (CC BY 4.0), provided you meet its conditions. You may remix, transform, and build upon the material for any purpose, even commercially, as long as you give appropriate credit to Munco as the original source, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in a way that suggests Munco endorses your use of the material. You may not apply legal terms or technological measures that legally restrict others from doing anything permitted under this license.

    You are not required to comply with the license if the material is in the public domain or if your use is allowed under an applicable exception or limitation, such as fair use. This is an informal summary of the CC BY 4.0 license and highlights only some of its key features and terms. You must carefully review all the terms and conditions of the full legal license before using any licensed material from Munco.

  • To ensure the Site functions properly and remains available to all people who need it, we ask that you respect the following use conditions:

    • You may not use automated tools such as "deep links", robots, spiders, or other similar programs to access, extract, copy, or monitor any part of the Site or its Content, unless they are expressly available for that purpose.

    • It is not permitted to attempt unauthorized access to any part of the Site, or to systems or networks connected to it, or to the accounts of other users, whether through illegitimate methods such as hacking or password extraction.

    • You may not perform actions that compromise the security of the Site, such as testing its vulnerabilities, reverse searches, information tracing, or attempting to obtain personal data that does not belong to you.

    • You agree not to overload the Site's infrastructure or affect its normal operation, nor to use any means that interfere with its functioning or with the experience of other users.

    • You may not falsify identities, manipulate headers, or represent yourself as another person or entity.

    • It is prohibited to use the Site or any of its contents for illegal purposes or in violation of these Terms of Use, as well as to promote activities that infringe upon Munco's rights or those of third parties.

  • Some features or services of the Site may require you to create an account, including a username and password. You are responsible for keeping your password and any other sensitive information associated with your account confidential. You are also responsible for any activity that occurs under your account if you fail to protect it adequately.

    If you detect unauthorized use of your account or any situation that could compromise your security, please notify us immediately. If another person misuses your account due to inadequate protection of your data, you may be held responsible for any damages caused to Munco or other users.

    You may not use another person’s account without their explicit permission. Munco assumes no responsibility for losses resulting from the misuse of someone else’s account or from poor management of personal data security.

  • At Munco, we value your trust and are committed to protecting your personal information. For this reason, we invite you to read our Privacy Notice, which applies to the use of this Site and is considered part of these Terms and Conditions. You can review it by clicking here.

    By browsing our Site or sharing your information with us, you acknowledge and accept that communications over the internet are never completely private or secure. This means that any message or information you send us may be read or intercepted by third parties, even if we use encryption tools to protect specific data, such as payment information.

    We make every effort to maintain high standards of security and privacy, but it is also important for you to take precautions when sharing sensitive information online.

  • Our Site may include links to other websites operated by third parties or independent entities ("Linked Sites"). We include these solely to facilitate access to information or services that may be of interest to you.

    It is important for you to know that we do not control the content, policies, or practices of these external sites. We do not endorse them, nor do we assume responsibility for them. When visiting a Linked Site, we recommend reviewing its own Privacy Notice and Terms of Use.

    Your visits to external sites are at your own risk and discretion. We trust that you will make informed and careful decisions when interacting with other online spaces.

  • At Munco, we strive to provide a transparent, functional, and useful service, but we also want you to know there are clear limits on what we can guarantee as a collective team.

    Unless prohibited by law, Munco assumes no responsibility for indirect, consequential, exemplary, incidental, or punitive damages, including loss of income or opportunities, even if you were previously advised of the possibility of such damages.

     

    If, despite these terms, it is determined that Munco is liable for any damage or loss arising from your use of the Site or its Content, our liability will be limited to the greater of: two thousand Mexican pesos ($2,000.00 MXN), or the total amount paid by you for the use of our services during the six months prior to the claim (excluding physical products and insurance). Some local laws may not allow this limitation, so it may not apply in your case.

    It is important for you to know that:

    • The Site and all its content are provided “as is” and “as available.”

    • We do not guarantee that it will be free of errors, interruptions, or defects.

    • We make no promises regarding specific results from its use.

    • We are not responsible for viruses, failures, or harmful characteristics in files downloaded from the Site.

    • We do not guarantee the accuracy, timeliness, merchantability, or fitness for a particular purpose of the information published.

    We also disclaim all liability for actions, omissions, or conduct of third parties related to the use of the Site or our services. Therefore, you agree that you assume full responsibility for how you use the Site and any linked site.

     

    Your sole remedy in the event of dissatisfaction with the Site or any of its content is to stop using it.

    This limitation of liability applies to any harm caused by errors, failures, interruptions, viruses, unauthorized access, or any other technical or human issue related to the Site.

    Additionally, at Munco we reserve the right to:

    • Modify, suspend, or cancel access to the Site or any of its features.

    • Update the design, functionality, or policies of the Site.

    • Temporarily interrupt the Site for maintenance or improvements.

    We may do any of these things at any time and without prior notice, always aiming to improve our services or ensure their technical sustainability.

  • By using this Site, you agree to indemnify and hold harmless Munco, its members, allies, collaborators, workers, agents, and affiliated entities from any claim, demand, expense, or loss (including attorney fees) arising from:

    • Your use of the Site.

    • Your breach of these Terms of Use.

    • Your violation of third-party rights.

    This indemnification commitment is a way for us to care for one another and ensure the collective project continues to function with shared responsibility.

  • At Munco, we believe in responsible and respectful use of the Site by all users. However, we also have an obligation to protect our community, our services, and everyone who interacts with us.

    If we detect a violation of these Terms of Use or any activity that may negatively affect other users or our project, we may take necessary actions to ensure the security and continuity of the Site.

    We may disclose any information we have about you (including your identity) if:

    • It is necessary to investigate or respond to a complaint.

    • It is required to identify, contact, or take legal action against someone infringing rights or causing harm to our Munco community.

    • There is a legal obligation, such as a law, court order, or applicable government request.

    • It is necessary to prevent or address fraudulent or illegal activities.

    We may also retain or share any message, communication, or interaction you make through the Site or any of our services when necessary:

    • To comply with legal processes.

    • To enforce these Terms of Use.

    • To respond to claims regarding possible violations of third-party rights.

    • To protect the rights, property, or safety of Munco, its members, users, or the general public.

  • At Munco, we reserve the right to cancel or block your access to the Site without prior notice if:

    • We detect that you have violated these Terms of Use or other related agreements.

    • We receive a request from competent authorities.

    • You voluntarily decide to delete your account.

    • We need to carry out significant modifications to the Site or face serious technical issues.

    You understand and agree that such actions may be necessary to protect our entire Munco community. In addition, you acknowledge that any serious breach of these Terms could cause harm that cannot be adequately repaired by monetary compensation alone, and therefore Munco may seek preventive or corrective legal measures (such as temporary or permanent injunctions) from the appropriate authorities.

    These measures do not exclude any other rights we may have under the law or principles of justice.

  • If Munco must take legal action against you for breaching these Terms of Use, you will be responsible for covering the reasonable associated costs, including attorney fees. This helps ensure the collective does not bear unfair losses due to individual actions.

    Finally, you acknowledge that Munco will not be liable to you or to third parties for cancellation of your access to the Site if such measure is taken due to a violation of these Terms of Use.

  • By using this Site, you agree that all matters related to your access or use are governed by the laws in force in the United Mexican States, without regard to conflicts of legal principles. You also agree that any dispute will be resolved before state or federal courts located in Mexico City, Mexico, and you waive any objection regarding jurisdiction or venue.

    However, if you are a user residing in the European Union, you may file any claim before the courts in your country of residence. This exception reflects our commitment to respecting local laws and the rights of international consumers.

    Any claim arising from these Terms of Use must be filed within one year from the date the cause of action arose. If not brought within this period, it will no longer be valid. This limitation does not apply to specific terms related to the purchase of products or services outside this platform.

    You may not receive compensation for general damages such as stress or inconvenience, except for direct personal expenses. The prevailing party in any legal proceeding may request costs and attorney fees, where permitted by law.

  • In the event of a dispute between you and Munco arising from your use of the Site, both parties agree to resolve the matter in good faith and within the shortest possible time. If no solution is reached within a reasonable period (maximum 30 days), we may proceed to mediation in order to reach a fair agreement.

     

    If the conflict persists after mediation, each party may take the legal actions it deems necessary under applicable law.

  • Munco operates primarily from Mexico City, although some site functions may be hosted or managed from locations outside the country. While the Site is accessible from anywhere in the world, not all services, products, or features are available in every region or suitable for all users.

    We reserve the right to limit the availability of any feature, product, or service on the Site as necessary or appropriate, without obligation to offer it in all geographic areas. Any offer made on the Site will be invalid in locations where prohibited by law.

    If you choose to access the Site from another country, you do so at your own risk and agree to comply with applicable local laws.

    By browsing the Site or using any of our services, you agree not to use, export, or re-export any Content, copy or adaptation thereof, or any of the products or services offered, in a manner that violates Mexican or international laws, including those related to foreign trade and export regulations.

  • If any legal or judicial authority determines that a part of these Terms of Use is invalid or unenforceable, an interpretation will be made to limit or adjust that provision only to the extent necessary, and an alternative reflecting its original intent as closely as possible will be sought. The remaining terms will remain in full force and effect.

    These Terms of Use represent the entire agreement between you and Munco regarding the use of the Site. Any prior agreements, whether written or oral, are superseded by this document, except for specific sales contracts you may enter into with professional members of Munco.

    Munco will not accept counteroffers or modifications to these terms unless formally agreed upon in writing. Failure to enforce strict compliance with any clause does not constitute a waiver of the right to enforce it at a later time.

    No part of these Terms shall be interpreted as granting rights to third parties who are not either you or Munco.

  • Any comment you leave on the Site will be considered non-confidential. We may use that information freely to improve our services, without restrictions or obligations toward you.

    The information published on the Site may include references to products, services, or programs that are not yet available in certain countries. This does not imply that Munco has immediate plans to offer them there.

    All content on the Site is subject to change without prior notice, always with the goal of providing you with more accurate and useful information.
