All services offered under the name of Munco are provided by independent professionals acting as individual contractors who have signed a collective agreement to adhere to the values, mission, terms and conditions, privacy notice, and other policies established on our official website and communication channels.
Contractual relationship
Toda relación contractual relacionada con la prestación de servicios será asignada directamente a una de nuestras profesionistas calificadas, quien será la responsable legal de cumplir con los términos del contrato y prestar los servicios acordados.
Responsables
Cada servicio ofrecido incluirá el nombre completo del profesionista responsable en todas las cotizaciones, contratos y facturas emitidas. El cliente acepta que su relación contractual será exclusivamente con dicho profesionista.
Collective agreement

Privacy is a human right
Although we are not yet a formally constituted cooperative, we already have digital spaces that align with our cooperative principles and values, which include respect for human rights, transparency, justice, and therefore the right to privacy.
Technological tools, as well as data collection and management systems, should serve people—not manipulate them. Their design must be participatory, open, and respectful of human autonomy. We must create common infrastructures for the secure and transparent handling of our data.
All members of Comunidad Munco (Cooperative Society in the process of formation) are responsible for the use and protection of your personal data, and we provide you with this Privacy Notice in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Individuals. Until our incorporation process is completed, we appoint Gustavo Peñaloza Díaz as the legal responsible party for privacy matters.

ARCO
We respect your rights of Access, Rectification, Cancellation, and Opposition, as outlined in the Privacy Notice and applicable legislation.
Autonomy
We will not request your personal data unless it is strictly necessary, and when collected, it will always be done in an informed, voluntary, autonomous, and independent manner.
Legal relationship
Strictly necessary situations are those in which the processing of your personal data is essential to establish legal relationships between the Owners and Munco, meaning information without which we would be unable to provide our services, as well as buy and sell products.
Optional requests
We will always give you the option to voluntarily provide your personal data for purposes that, while not essential, may create opportunities for building mutual support networks and enhance your experience on our platforms.
Exclusion List
In accordance with Fraction IV of Article 2 of the Regulation of the Law, it is hereby informed that Munco maintains a database whose purpose is to record, free of charge, the refusal by data subjects regarding the processing of their personal data.
Revocation
Consent may be revoked by any individual at any time, specifying whether the revocation is partial or total, and whether it applies to essential data, non-essential data, or both.
Legal obligation
There are cases in which, due to legal or contractual obligations, we may not be able to honor requests for revocation of consent, whether partial or total. For example, if you request the deletion of your transaction data and Munco is legally required to maintain a record of transactions in accordance with applicable regulations.
Exceptions
In rare cases, we may deny a request if complying with it undermines our legitimate use of data for fraud prevention and security purposes. For example, if you request the deletion of an account that is under investigation for security reasons, and such action would compromise the privacy or safety of individuals within Munco or third parties.
Personal data
At Munco, we build diverse and secure virtual spaces. Depending on the level of trust established, we may collect different types of information, such as the following:
Account
When you create an account on munco.mx and related account details, such as: name, email address, registered devices, account status, and date of birth to verify that you are of legal age.
Devices
Data from which the device can be identified, or details about the device, such as browser type, location, and activity on our platform munco.mx.
Messages
When you contact us, we may request information such as your name, email address, physical address, phone number, or other contact details necessary to respond to your inquiry.
Contact
Detailed information about your communications with us, including interactions with our platforms and services, as well as contacts made through social media such as WhatsApp and Instagram.
Transactions
Data regarding your purchases of our products and services, and transactions facilitated by Munco, such as purchases made through our digital platform for sales and service contracts.
Payments
Billing information, payment methods, and financial data such as credit or debit card details or other payment cards, including cardholder name, card number, CLABE, and financial institution.
Usage
Data about your activity and usage of our platforms, such as access to service-related platforms, browsing and search history, interaction with products, errors, performance, and diagnostic information.
Location
Approximate location of your devices to enable the use of region-specific services, and demographic data to assess the impact of our platform and social innovation projects.
Image
In case you choose to add a photograph of yourself as your profile picture on your Munco account. Also, to document in-person and virtual events or meetings of Munco that you attend.
Health
Health-related data, in case you choose to share it, including information about your physical or mental condition. This may be used to implement accessibility adaptations, ensure equitable access to our platforms, and identify the needs of our communities.
Finance
Information about your income, in case you choose to share it, and information related to Munco’s financial offerings. This may be used to identify the needs of our communities.
Documents
We may request a government-issued identification document in essential circumstances, such as when you join our collective and sign a legal contract, establish an alliance, make reservations, or when required by law.
Prevention
Data used to help identify and prevent fraud, such as device trust scores or detection of illegal or unauthorized tools like bots and malware.
Important notice
Remember, you are under no obligation to provide us with your personal data. However, without such information in the essential cases detailed above, we may not be able to offer you certain products or services, or respond to specific requests you wish to make.
Data from other sources
At Munco, we may receive your personal data from other individuals, businesses, or third parties acting upon your instructions, allied partners who collaborate with us to provide our products and services, support initiatives related to well-being and safety, and other legitimate sources.
Personas
We may collect your personal data from other individuals; for example, if someone has sent you a product or gift card, invited you to participate in Munco, or shared content with you.
Entities
You may instruct third parties to share data with us. For example, you can request Administrators, Companies, or Public Registries to share documents containing your personal information to carry out legal procedures or issue certifications required to access certain Munco services and products.
Allies
We may also verify the information you provide, for example, when creating a Munco account, by cross-referencing with a third party for security purposes and fraud prevention.
Social Innovation
To enhance features such as search and as a source for our models, Munco uses publicly available information from the internet. We have measures in place to minimize the amount of personal data collected, and we do not attempt to link the gathered data to any specific Munco user or create personal profiles.
If the purpose is research and development, we may use datasets containing demographic or other information that could potentially relate to identifiable individuals, always with their explicit consent. When using such datasets for research and development purposes, we do not attempt to re-identify the individuals contained within them.
What do we use your personal data for?
At Munco, we only use your personal data when there is a valid legal basis for doing so. Our primary goal in using your personal data is to create communities, platforms, and services that improve people’s quality of life. This includes: processing transactions; creating and maintaining collaborative community spaces, both physical and virtual; communicating with you; ensuring security and fraud prevention; and complying with the law.
We may also use your personal data for other purposes, provided we have your explicit consent. Additionally, we may process your personal data when acting in the legitimate interests of our communities, while always taking into account your own interests, rights, and expectations.

If you do not wish for your non-essential personal data to be processed, you may send an email at any time to contacto@munco.mx, stating your full name and a clear description of your request. Your refusal regarding the use of non-essential data cannot be a reason for us to deny you the services or products you request or contract with us.
Who might we share your data with?
To carry out the purposes described above, or others required by law or competent authorities, Munco may share your personal data with collectives, individuals, companies, organizations, and authorities only when strictly necessary for the execution of contracted services and the creation of in-person and virtual community platforms that require the involvement of third parties acting under our instructions and security protocols. Likewise, Munco will never share your personal data with third parties for purposes other than those specified below:
Suppliers
At Munco, we may engage third parties to act as service providers and perform certain tasks on our behalf, such as processing or storing data—including personal data—in connection with the use of our services and the delivery of products to customers. Munco’s service providers are obligated to handle personal data in accordance with this Privacy Notice and strictly following our instructions. They may not use the personal data we share for their own purposes and must delete or return the personal data once our request has been fulfilled.

If you purchase a service or product from third parties through our platform munco.mx, we create an exclusive subscriber ID for you and the developer or publisher. This subscriber ID may be used to provide reports to the developer or publisher, including information about the subscription you have purchased and your country of residence.

Digital and physical spaces or events that require attendee lists.
Other
At Munco, we may share personal data with other third parties following your instructions or with your consent—for example, if we share information with an allied collective to jointly organize a workshop. Likewise, we may disclose information about you if we consider such disclosure necessary or appropriate for reasons of national security, compliance with current legislation, or other significant public interest grounds.

How long do we keep your data?

Access
In accordance with the provisions of Article 23 of the Law, you have the right to obtain your personal data from Munco, as well as information relating to the conditions of the processing.
Rectification
In accordance with the provisions of Article 24 of the Law, you may at any time request Munco to rectify your personal data that is inaccurate or incomplete.
Cancel
In terms of Article 25 of the Law, cancellation implies the cessation of processing by the Munco collective, starting from a blocking of the same and its subsequent deletion.
Opposition
In accordance with Article 27 of the Law, you may at any time object to the processing of your personal data or demand that it be ceased for specific purposes, as outlined in Article 109 of the Regulation.

Please note that in some cases, the presence of the data subject or their legal representative may be required at an agreed-upon location.

It is important to note that when processing your request, we will ensure that the exercise of these rights does not hinder compliance with applicable laws or court orders, or interfere with the obligations arising from the legal relationship between you and Munco. Likewise, you should understand that for certain purposes, revoking your consent may mean that we are unable to continue providing the requested services, or may result in the termination of your relationship with us.
